To Fix the Term of the Tenancy or to Not
With the changes to the Residential Tenancies Act on 12 August 2020, Fixed Term Tenancies may not be as attractive as they once were, depending on why you favoured this type of agreement. Landlords have now lost the right to end the tenancy, without reason or grounds, at the completion of the fixed term. Now with the tenancy automatically converting to a periodic tenancy at the end of the fixed term, unless either party gives notice to terminate tenancy under the new periodic tenancy requirements, the tenancy will endure. If you favoured the Fixed Term because the rent was guaranteed for 12 months then this is still a good option. Which tenancy arrangement we chose for a property is assessed on a case by case basis or as instructed by our client's.

Fixed Term Transition
Maintaining a rapport with tenants will help us to gauge whether they are settled at your property, whether it fits their needs or whether their needs have changed. So any decision they may make regarding their tenure at the property shouldn’t come as too much of a surprise and the transition to a period tenancy or termination should be a smooth one. We are however, proactive in offering the tenant’s options which will lead to the best result for both our client and tenant.
